01Agreement to Terms
By accessing or using Gavel ("the App," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access or use the App.
02Description of Service
Gavel is a gamified household management application that allows users to:
- Create and manage household tasks and personal habits
- Earn and spend house points
- Use power cards with various effects to strategize and level up on the leaderboard
- Participate in a rotating Judge system and rule the house
- Trade tasks and power cards on a marketplace
- Track streaks and achievements
03Eligibility
3.1 Age Requirements
- All Ages Welcome: Gavel can be used by users of all ages, including children under 13.
- Parental Consent Required: Users under 13 must have parental or guardian consent to use the App. By creating an account for a child under 13, parents/guardians agree to these Terms on behalf of their child.
- Users Aged 13–17: Users aged 13–17 should have parental or guardian supervision when using the App.
- Judge Role Restriction: Users must be at least 13 years old to serve as a Judge in the rotating Judge system. Children under 13 can participate in all other features (tasks, points, cards, marketplace) but will not be assigned as Judge.
- Parental Responsibility: Parents/guardians are responsible for supervising their children's use of the App and ensuring appropriate household rules are set.
3.2 Account Requirements
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the security of your account credentials.
- You must notify us immediately of any unauthorized access to your account.
- One person may not maintain multiple accounts to circumvent App limitations.
04User Conduct
4.1 Acceptable Use
You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:
- Violate any applicable laws or regulations
- Infringe upon the rights of others
- Harass, abuse, or harm other users
- Post false, misleading, or fraudulent information
- Attempt to gain unauthorized access to the App or other users' accounts
- Use automated systems (bots, scripts) to interact with the App
- Interfere with or disrupt the App's functionality
- Reverse engineer, decompile, or disassemble the App
- Use the App to transmit viruses, malware, or harmful code
- Create fake tasks or manipulate the point system
- Abuse the Judge system or marketplace features
4.2 Household Rules
- You are responsible for setting appropriate household rules within the App.
- We are not responsible for disputes between household members.
- The Judge system is a game feature and should be used fairly and in good faith.
- Judge Eligibility: Only users aged 13 and older can be assigned as Judge. The App automatically excludes users under 13 from Judge rotation.
4.3 Content You Submit
- You retain ownership of content you submit (photos, tasks, etc.).
- You grant us a license to use, store, and display your content to provide the App's services.
- You are responsible for ensuring you have the right to submit any content.
- We reserve the right to remove content that violates these Terms.
05Premium Subscription
5.1 Subscription Terms
- Premium subscriptions (Gavel Pro) are available for $7.99/month or $59.99/year (approximately 27% discount compared to monthly billing, or equivalent in local currency).
- The Free tier allows for a limited household size of up to 3 members.
- The Premium subscription supports a Household Plan allowing up to 7 household members.
5.2 Billing
- Subscriptions are billed through Apple App Store or Google Play Store.
- Subscriptions automatically renew unless cancelled.
- You can cancel your subscription at any time through your device's app store settings.
- Refunds are subject to Apple App Store and Google Play Store policies.
5.3 Price Changes
- We reserve the right to change subscription prices with 30 days' notice.
- Existing subscribers will be notified of price changes.
06Intellectual Property
6.1 Our Rights
- The App, including its design, features, and content, is owned by us or our licensors.
- All trademarks, logos, and brand names are our property.
- You may not copy, modify, or create derivative works of the App.
6.2 Your Rights
- You retain ownership of content you create and submit.
- You grant us a non-exclusive, worldwide, royalty-free license to use your content to provide the App's services.
07Disclaimers
7.1 Service Availability
- The App is provided "as is" and "as available."
- We do not guarantee uninterrupted or error-free service.
- We reserve the right to modify, suspend, or discontinue the App at any time.
7.2 No Warranties
- We make no warranties, express or implied, regarding the App's accuracy, reliability, or suitability.
- We do not warrant that the App will meet your requirements or be error-free.
7.3 Third-Party Services
- The App may integrate with third-party services (Supabase, payment processors).
- We are not responsible for third-party service availability or functionality.
08Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
- Our total liability shall not exceed the amount you paid for Premium subscriptions in the past 12 months.
- We are not liable for disputes between household members.
- We are not liable for loss of data, points, achievements, or other in-app content.
09Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any rights of another
- Content you submit
10Termination
10.1 By You
- You may stop using the App at any time.
- You may delete your account through the App settings.
10.2 By Us
We may suspend or terminate your account if you:
- Violate these Terms
- Engage in fraudulent or illegal activity
- Abuse the App's features
- Fail to pay subscription fees (for Premium users)
10.3 Effect of Termination
- Upon termination, your right to use the App ceases immediately.
- We may delete your account and data (subject to legal retention requirements).
- Provisions that should survive termination will remain in effect.
11Dispute Resolution
11.1 Informal Resolution
- Contact us at support@playgavel.com to resolve disputes informally.
- We will attempt to resolve disputes within 30 days.
11.2 Binding Arbitration
- For disputes that cannot be resolved informally, you agree to binding arbitration.
- Arbitration will be conducted under applicable arbitration rules.
- You waive your right to a jury trial.
11.3 Class Action Waiver
- You agree not to participate in class action lawsuits against us.
- Disputes must be resolved individually.
12Governing Law
These Terms are governed by the laws of Canada, without regard to conflict of law principles.
13Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by:
- Posting updated Terms in the App
- Updating the "Last Updated" date
- Sending email notification (for material changes)
Your continued use of the App after changes become effective constitutes acceptance of the updated Terms.
14Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
15Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.
17Additional Terms
17.1 Beta Features
- We may release beta features that are subject to additional terms.
- Beta features may be unstable or removed without notice.
17.2 Export Restrictions
- The App may be subject to export control laws.
- You agree to comply with all applicable export and import laws.
17.3 Force Majeure
- We are not liable for delays or failures due to circumstances beyond our control (natural disasters, war, etc.).
By using Gavel, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
